Alleged Contempt: Judge Threatens To Jail Former NAPPS president, Otubela, Bodunde others.

Justice Daniel E. Osiagor of the Federal High Court, Lagos has threatened to jail the former president, National Association of Proprietors of Private Schools, NAPPS Lagos State chapter, Mr Yomi Otubela, Durodola Bodunde and others over disobedience to order of the court.

They are members of NAPPS Lagos desperately attempting to cause unnecessary disintegration of the association which is being led by Yomi Otubela, proprietor of Lagooz school Agege, follow by Durodola Olajide of Dobar school, Maya Ikorodu, Bodunde Samuel of First Apex School Aminkanle Road Alagbado, Oluyemi Richard – Great Richard Nursery and primary school and Shafiriyu Ganiyu of Virgo Gay school Shomolu, Fly Cable News gathered.

While issuing the “Contemnors Notice of Consequences of Disobedience of Court Order” held that their actions to the rule of law, is an affront to the 1999 constitution, the court stated. “Notice is hereby given to the contemnor that except you obey the directions obtained in the order annexed hereto, you will be guilty of contempt of court and liable to be committed to prison. Dated this 12th day of March, 2025.”

In light of their level of desperation and unauthorized activities, a request was made to impose “Post-No-Debt” restrictions on the association’s account, effective from November 4th, 2024. Following the court’s decision, Sterling Bank’s legal team issued a letter stating compliance with the order to lift the “Post No Debt Restrictions.” Meanwhile, the authentic executive members of NAPPS have taken full control of the account and are overseeing operations at the NAPPS Secretariat.

Previously, the Federal High Court in Lagos nullified the petitions of NAPPS’s former president, Yomi Otubela, & Co., along with all actions taken against the association, and upheld the status quo as of 23rd February 2024.

The court made this pronouncement while delivering judgement in an action filed by Yomi Otubela against incorporated trustees of the National Association of Proprietors of Private Schools, NAPPS, led by Alhaji Minjiyawa and the Baale Shakiru Raji secretary to the BOT in suit FHC/LOS/279/2024.

The presiding judge, Justice Daniel E. Osiagor, said, “I hereby order that every step taken by the parties is hereby nullified and mandates an immediate reversal of changes made at the Corporate Affairs Commission (CAC), decisions, and alterations by the Board of Trustees (BOTs).

The court also ordered the implementation of the 2017 constitution, not in recognition of the 2023 constitution as imposed by Otubela. Rules that implement the 2023 NAPPS Constitution, unlawful sealing of the NAPPS Lagos Secretariat, unfreezing of NAPPS Lagos State accounts, and stopping the imposition of executive leaders over the duly elected NAPPS Lagos State and Ekiti officials.

The judge stated that Otubela’s actions are illegal and constitute contempt of court, for which he can be jailed. He urged his counsel to educate him on the implementation of such illegal actions, including the placement of restriction orders on accounts by his selected BOT, illegal police harassment, cyberbullying, and the unlawful nomination of officers in different states.Having been satisfied that the respondents are aware of the court order, the court, in the exercise of its powers, set aside an action to prevent anyone from flouting the orders of the court and going scot-free with it.

Reacting to the court’s decision, Lagos NAPSS president, High Chief Alaka Yusuf, executive members, and Board of Trustees (BOT) hail the judgement and reinforce the supremacy of the rule of law and uphold the democratic structures of NAPPS Lagos State.

Alaka committed to upholding the rule of law and fostering unity within the association, adding that NAPPS remains the only legitimate body recognised by law with a Board of Trustees (BOT)
led by Alhaji Minjiyawa and the National president Hajia Samira Jibrin PhD and National Executive Council (NEC).

Recall that Yomi Otubela is employing certain elements to challenge Chief Yusuf Alaka, alongside the association, in a legal battle over alleged tenure elongation and the rightful presidency of NAPPS in the Lagos State chapter.
