Supreme Court Reinstates Anyanwu as PDP National Secretary

The Supreme Court on Friday overturned the rulings of both the Court of Appeal and the Federal High Court in Abuja, which had removed Senator Samuel Anyanwu as the National Secretary of the People’s Democratic Party (PDP).
A five-member panel of the apex court ruled that the selection of a party’s National Secretary falls under the internal affairs of a political party and is not subject to judicial review.
Delivering the lead judgment, Justice Jamilu Tukur struck out the Federal High Court’s October 2024 verdict and set aside the majority decision of the Court of Appeal, which had upheld Anyanwu’s removal in December. Instead, the Supreme Court affirmed the minority judgment by Justice Ekanem, which had nullified the lower court’s ruling on the basis of lack of jurisdiction.
The court also held that the plaintiff, Aniagu Emmanuel, who initiated the case, lacked the legal standing to challenge the appointment, as he failed to prove how he was directly affected by Anyanwu’s position as PDP’s National Secretary.
