President Pretty Okafor Surpasses All Constitutional Requirements Amid Attempts to Undermine His Leadership..
The Performing Musicians Employers Association of Nigeria (PMAN) proudly announces that President Pretty Okafor has met and exceeded all constitutional requirements necessary to continue as the union leader. His steadfast leadership has garnered unprecedented support from members of the National Executive Council (NEC), making him the first President in PMAN’s history to achieve such an extraordinary level of endorsement.
*Disgruntled Members’ Attempts to Suspend President Okafor*
Recently, while President Pretty Okafor was abroad promoting PMAN and working tirelessly to elevate the association’s profile on the global stage, a faction of disgruntled members attempted to suspend him. This move, orchestrated by a select group within the National Working Committee (NWC), was not only procedurally improper but also lacked the constitutional authority to do so.
As reported on Monday, August 26, 2024, the NWC does not possess the jurisdiction to unilaterally suspend the President. According to the PMAN Constitution, such actions must be based on findings by a duly constituted Disciplinary Committee, which had not been established at the time. Article 18 (A) of the PMAN Constitution explicitly states that any suspension must be based on a finding of guilt by a properly convened Disciplinary Committee. Furthermore, Article 18 (D) guarantees every member the right to a fair hearing before any disciplinary action is taken. The NWC’s attempt to bypass this due process was therefore null and void.
*Surpassing Constitutional Requirements and Setting a New Standard*
Despite these attempts to undermine his leadership, President Pretty Okafor has demonstrated exceptional resilience and commitment to upholding the integrity of PMAN. In response to these challenges, he has rallied the NEC members, and their overwhelming support has far surpassed the quorum requirement outlined in Articles 11 (B) and 11 (H) of the PMAN Constitution.
The NEC, which comprises 31 members, requires at least one-third (11 members) to form a quorum for its meetings. Under President Okafor’s leadership, more than the required number of NEC members have signed documents affirming their support and participation, thereby exceeding the constitutional requirements by a significant margin. This level of support is unprecedented in PMAN’s history and showcases the deep trust and confidence that the NEC members have in President Okafor’s vision and leadership.
*No Jurisdiction for Suspension*
This strong show of support also highlights a crucial point: the National Working Committee (NWC) lacks the jurisdiction to suspend the President without following due process. The PMAN Constitution is clear on this matter. The NEC, as the highest decision-making body within PMAN, must be fully involved in any disciplinary proceedings. The recent actions taken by the NWC to suspend President Okafor while he was away are not only outside their constitutional remit but also undermine the democratic principles upon which PMAN was founded.
*A Historic Milestone for PMAN*
President Pretty Okafor’s ability to exceed quorum requirements is a historic milestone for PMAN. This achievement underscores his commitment to inclusivity, fairness, and transparency. By actively engaging with NEC members and ensuring a robust and democratic process, President Okafor has set a new benchmark for leadership within the association. His actions reflect a deep respect for PMAN’s constitution and a dedication to the principles of good governance.
*Moving Forward with Renewed Strength*
PMAN is stronger than ever under President Pretty Okafor’s leadership. The association remains united in its mission to protect and promote the interests of performing musicians across Nigeria. The overwhelming support from the NEC members reaffirms that President Okafor’s leadership is not only legitimate but also essential for the continued growth and success of PMAN.
PMAN calls on all members to remain united and focused on our shared goals. Together, we can overcome any challenges and build a stronger, more resilient association that stands up for the rights of all its members.
President Pretty Okafor has demonstrated unparalleled leadership, exceeding all constitutional requirements amid attempts to undermine his authority. His commitment to fairness, integrity, and due process has set a new standard within PMAN. The association proudly stands behind a leader who continues to break barriers, uphold our constitution, and lead with unwavering dedication.
