Court of Appeal Removes PDP’s Atigwe, Declares LP’s Agbo as Winner of Enugu Constituency Seat
The Court of Appeal in Enugu has confirmed the removal of Hon. Simon Atigwe of the Peoples Democratic Party (PDP) from the House of Representatives, upholding the Election Petition Tribunal’s decision. Hon. Dennis Nnamdi Agbo of the Labour Party (LP) has been declared the rightful winner of the February 3, 2024 re-run election for the Igbo-Eze North/Udenu Federal Constituency.
The three-member panel, led by Justice Ekanem, delivered a unanimous judgment, which was read by the panel chairman. Labour Party lawyer Ifeanyi Ogenyi celebrated the decision, congratulating the constituency and stating that “truth and justice have prevailed.”
Previously, the Independent National Electoral Commission (INEC) had declared Atigwe the winner of the re-run election. However, Agbo, who had initially won the February 25, 2023 election but was later removed, challenged Atigwe’s declaration in both the tribunal and the Appeal Court, ultimately winning his case.
