If Nnamdi Kanu interested in negotiations, he knows the right place -Adegboyega Awomolo
According to the report from the Vanguard, The detained leader of the proscribed “Indigenous People of Biafra,” IPOB, Nnamdi Kanu, has expressed his readiness to enter into a negotiation with the Federal Government.
Kanu articulated his stance on Wednesday during the resumed proceedings on the seven-count terrorism and treasonable felony charge that the Federal Government lodged against him before the Federal High Court in Abuja.
His legal team, headed by Mr. Alloy Ejimakor, highlighted Section 17 of the Federal High Court Act, which provides for the amicable resolution of such matters.
Ejimakor informed the court about his team’s decision to explore the negotiation option after moving two applications on behalf of his client. One application sought the committal of the Director-General of the Department of State Services, DSS, Mr. Yusuf Bichi, to prison for contempt of court, while the second motion challenged the court’s jurisdiction to proceed with the trial.
He said, “Section 17 of Federal High Court Rules, states that in any proceedings, the court may consider reconciliation and settlement,”.
Should the court dismiss the two applications, Kanu’s lawyer emphasized that he would resort to activating Section 17 of the Federal High Court Act, which allows for reconciliation and settlement in legal proceedings.
In response, the Federal Government’s lawyer, Chief Adegboyega Awomolo, SAN, clarified that he had previously informed the defendant of his lack of authority to engage in negotiations. He affirmed that only the Attorney-General of the Federation and Minister of Justice possesses the mandate to negotiate or take further action regarding the case, given its nature involving alleged terrorism.
Reacting to the situation, trial Justice Binta Nyako stressed that the court’s role is to consider the matter presented and not to act as a legal representative for any party. She highlighted that it is up to the parties involved to agree on how they wish to proceed with the case.
